The Winnebago County Board of Supervisors adopted a new countywide zoning code on March 20, 2012. Because this new zoning code, adopted as Chapter 23 of the general county code, constitutes a comprehensive revision, all of the towns currently under county zoning have the ability to opt out. If such a town does not adopt their own zoning regulations within one year, then no zoning applies within that town, except for state-mandated zoning including floodplain zoning and shoreland zoning.

At this time, there are eight towns under county zoning (Chapter 17), including Algoma, Clayton, Menasha, Nekimi, Neenah, Omro, Oshkosh, and Winchester. The following towns have adopted and administer their own zoning regulations:
  • Black Wolf
  • Nepeuskun
  • Poygan
  • Rushford
  • Utica
  • Vinland
  • Winneconne
  • Wolf River

Depending on the location of a project, it could be subject to more than one set of zoning regulations. These include the following:
  • Floodplain Zoning Code (chapter 26 of the general code)
  • Town/County Zoning Code (chapter 17 or 23 of the general code) OR Town Zoning
  • Shoreland Zoning Code (chapter 27 of the general code)
  • Wittman Regional Airport Zoning Code (chapter 24 of the general code)
  • Outagamie County Airport zoning regulations
